The Ride Board maintains a zero tolerance “spam” policy. Should you nevertheless bring legal action against us, you irrevocably agree that regardless of any statute or law to the contrary, it will be brought and maintained on an individual basis (and not consolidated with similar cases) within one (1) year after the claim arises or be barred. As disincentive for unwarranted litigation, you agree that if you sue us and don't win on the merits, you will pay our defense costs, including reasonable legal fees for in-house and outside counsel. If we are required to enforce this Agreement or our rights, you agree it is reasonable to send you legal notices and papers by electronic mail at your stated address (we would also attempt to send you a backup copy by regular mail). You and The Ride Board agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Nevada. The failure of The Ride Board to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

14. VIOLATIONS OF TERMS AND CONDITIONS AND LIQUIDATED DAMAGES

Please report any violations of the Terms and Conditions, by forwarding the posting(s) for review, or by emailing to abuse@Universityrideboard.com. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

You understand and agree that, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you will be liable to pay The Ride Board liquidated damages as follows:

a. If you post a message that (1) impersonates any person or entity; (2) falsely states or otherwise misrepresents your affiliation with a person or entity; or (3) that includes personal or identifying information about another person without that person's explicit consent, you agree to pay The Ride Board one thousand dollars ($1,000) for each such message.

b. If The Ride Board establishes limits on the frequency with which you may access the Service, or terminates your access to or use of the Service, you agree to pay The Ride Board one hundred dollars ($100) for each message posted in excess of such limits or for each day on which you access The Ride Board in excess of such limits, whichever is higher.

c. If you send unsolicited email advertisements to The Ride Board users via the Universityrideboard.com website or the Service or through The Ride Board computer systems, you agree to pay The Ride Board fifty dollars ($50) for each such email.

d. If you display unauthorized commercial advertisements to The Ride Board users via messages posted on the Universityrideboard.com website or the Service or through the The Ride Board computer systems, you agree to pay The Ride Board two hundred and fifty dollars ($250) for each such message.

e. If you post messages in violation of these Terms and Conditions, other than as described above, you agree to pay The Ride Board one hundred dollars ($100) for each such message. In its sole discretion, The Ride Board may elect to issue a warning before assessing damages.

Otherwise, you agree to pay The Ride Board actual damages, to the extent such actual damages can be reasonably calculated.

15. COMPLAINTS, COMMENTS, SUGGESTIONS

To resolve a complaint regarding the Universityrideboard.com website or the Service, you should first contact User Support at help@universityrideboard.com. You may also, of course, contact your state’s consumer protection agency. We welcome your comments, complaints or suggestions on this document at our community forum. The Ride Board is not affiliated nor indorsed with any of the Universities that are posted on this site. The Ride Board simply provides this service for students of those universities.
